Terms of Service

1. About these terms

These Terms of Service (“Terms”) govern the use of PumpBeat Creative Studio (“PumpBeat”, the “Service”), operated by Roxana Mendriel, Lima, Peru (“we”, “us”). By connecting an account, using the studio or opening a client review link, you agree to these Terms and to our Privacy Policy.

2. The Service

PumpBeat is a private tool used by Roxana Mendriel to plan, produce, approve, schedule and publish social media content for the brands she manages, and to measure its results. It is not open to public registration. Brands (“Clients”) use it through the operator and through private review links.

3. Authorization to manage accounts

A Client may connect its Instagram, Facebook or TikTok account using the official login of each platform. By doing so, the Client confirms that it owns or is authorized to manage that account and authorizes us to read its data and to publish on it, only as described in the Privacy Policy and only content that has been approved and scheduled.

Nothing is published without approval. Each piece is approved by the operator and, when the Client requests it, by the Client through its review link before being scheduled. For TikTok, the privacy level, interaction settings and commercial content disclosure are chosen at the moment of scheduling and shown before publishing.

The Client can revoke this authorization at any time from the settings of each platform or by contacting us.

4. Content and intellectual property

The Client keeps all rights to its brand, materials and published content. The Client grants us a limited license to use its materials only to provide the Service.

The Client is responsible for having the rights to the materials it provides (images, videos, music, trademarks, people appearing in the content). Content must comply with the law and with the rules of each platform, including TikTok’s Community Guidelines and Branded Content Policy and Meta’s Community Standards.

When we analyze public posts or “reference” videos, we use them only to study structure and trends. We do not copy third-party content.

5. Acceptable use

You may not use the Service to publish illegal, deceptive, hateful or infringing content; to spam; to access accounts without authorization; to collect data about other users; or to circumvent the limits or rules of any platform.

6. Third-party platforms

The Service depends on Instagram, Facebook, TikTok and other providers. Their availability, rules and features may change. We are not responsible for their decisions, outages or changes, including the rejection, removal or reduced reach of content.

7. Results and availability

We work to make the Service reliable and secure, but it is provided “as is”. We do not guarantee specific results such as views, followers or sales. Scheduled publishing may occasionally fail because of platform errors; in that case we notify the operator so the piece can be published manually.

8. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential damages, loss of profits or loss of data arising from the use of the Service or of third-party platforms.

9. Suspension and termination

The Client may stop using the Service and disconnect its accounts at any time. We may suspend access to protect the Service, the Client or third parties, or if these Terms are breached. When the relationship ends, data is deleted as described in the Privacy Policy.

10. Changes

We may update these Terms. The date at the top shows the latest version. Continued use after a change means acceptance of the new Terms.

11. Governing law

These Terms are governed by the laws of Peru. Any dispute will be submitted to the courts of Lima, Peru, unless mandatory law provides otherwise.
